TexPIRG’s consumer program works to alert the public to hidden dangers and scams and to ban anti-consumer practices and unsafe products.

For 30 years, TexPIRG’s "Trouble In Toyland" report has surveyed store shelves and identified choking hazards, noise hazards and other dangers. Our report has led to at least 150 recalls and other regulatory actions over the years.

BIGGER BANKS, BIGGER FEES

In April, TexPIRG released a report in which we surveyed more than 350 bank branches and revealed that fewer than half of branches obeyed their legal duty to fully disclose fees to prospective customers, while one in four provided no fee information at all. We also found that despite widespread stories about the “death” of free checking, free and low-cost checking choices are still widely available, if consumers shop around.

Popular toys contain toxics and other hazards

This holiday season, watch out for dangerous and toxic toys. TexPIRG’s 33rd annual Trouble in Toyland report found toxic amounts of boron in slime products and a failure by Amazon to appropriately label choking hazards. Boron can cause nausea, vomiting and other health issues.

“No one should worry about whether or not the toy they’re buying is toxic or dangerous. But in 2018, we’re still finding hazards in some of the most popular toys. Toy manufacturers must do better to ensure their products are safe before they end up in children’s hands and mouths,” said Bay Scoggin, TexPIRG Director.

TexPIRG Recommends Credit Freezes, Now Free for All By Law

A new federal law eliminates fees for getting and removing credit freezes in Texas and across the country at the three nationwide credit bureaus on September 21st. The consumer advocacy group TexPIRG recommends getting credit freezes, not the similar locks offered by the bureaus, to prevent new account identity theft.

 

In 2003, TexPIRG led the effort in the Texas legislature to pass one of the nation's first laws creating security freezes. However, the law required consumers to pay $10 per freeze per credit bureau, for a total of $30. In the 2017 Equifax data breach, Attorney General Ken Paxton says that 12 million Texans had their information stolen.

"It’s about time the credit bureaus stopped charging us for the right to control our own information. We didn’t give them permission to collect or sell our information in the first place," said Bay Scoggin, TexPIRG’s State Director

32nd Annual “Trouble in Toyland” Survey Finds Dangerous Toys on Store Shelves

Austin – Stores nationwide are still offering dangerous and toxic toys this holiday season and, in some cases, ignoring explicit government safety regulations in the process, according to Texas Public Interest Research Group (TexPIRG) Education Fund’s 32nd annual Trouble in Toyland report. The survey of potentially hazardous toys found that, despite recent progress, consumers must still be wary when shopping for children’s gifts.

The report exposes fidget spinners full of lead, inadequately-labeled toys and balloons that pose a choking hazard, and data-collecting toys that may violate children’s privacy and other consumer protection laws. We also provide a list of toys that have been recalled over the past year.

“We should be able to trust that the toys we buy are safe. However, until that’s the case, toy buyers need to watch out for common hazards when shopping for children’s presents,” said Bay Scoggin, TexPIRG Director.

Target Removes Lead-Laden Fidget Spinner From Website, But Still Available For Sale In-Store

Since late yesterday afternoon, Target appears to have made the 33,000 ppm-lead containing Fidget Wild Premium Spinner Brass unavailable for sale on its website. U.S. PIRG Education Fund staff went to a Target store today and found the Fidget Wild Premium Spinner Brass was still available for sale in-store, despite the website saying it was unavailable there. Also yesterday, one of the CPSC’s Commissioners, Elliot F. Kaye, re-stated his opposition to the CPSC’s guidance and the acting chairman's statement when he tweeted, “Seems obvious fidget spinners are toys and should comply with all applicable federal safety standards.”

Wall Street Ramps Up Attacks on Wall Street Reform | Ed Mierzwinski

On Friday, the House overwhelmingly approved a Wall Street-driven proposal to weaken oversight of private equity firms, taking a chunk out of the 2010 Dodd-Frank Wall Street Reform and Consumer Protection Act. But wait, there's so much more: On Tuesday the House Financial Services Committee takes up the so-called "Financial Choice Act," which eviscerates most of Dodd-Frank's key reforms, from stripping powers of the Financial Stability Oversight Council to repealing the Volcker Rule, which reins in risky betting practices that use depositors' money. As for the CFPB (which just this week issued its biggest fine to date, $100 million against Wells Fargo Bank for opening hundreds of thousands of fake and secret consumer accounts to meet sales goals), the proposal would defund and defang it and delay or stop its efforts to rein in unfair practices of payday lenders, debt collectors and banks. Many of the Financial Choice Act's provisions also pose threats as budget bill "riders."

Good news! CFPB Adding Consumer Ratings of Company Responses to Complaint Database | Ed Mierzwinski

The CFPB is making a good public consumer complaint database better. In 2015, the CFPB added optional consumer narratives, or stories, to its public consumer complaint database, giving other consumers, researchers and even other firms a new way to help study complaint patterns. Now, it will give consumers a chance to “rate the company’s handling of his or her complaint on a one-to-five scale and provide a narrative description in support of the rating.”

Court Rejects PIRG-Opposed Swipe Fee Settlement With Visa/Mastercard | Ed Mierzwinski

Today, a panel of the U.S. Court of Appeals for the Second Circuit threw out a preliminary $7.25 billion settlement between Visa and Mastercard and any merchant accepting credit cards (including U.S. PIRG), ruling that despite that seemingly massive payment for past practices that the settlement gave inadequate relief to merchants going forward, as it essentially immunized the networks for any future illegal conduct while providing mostly illusory benefits. Since we accept credit cards from our members, we, joined by Consumer Reports, had formally objected to the settlement as consumer advocates who also happen to be merchant class members (most merchant associations also objected).

The legislative session adjourned on Monday, with consumers and the public interest claiming some big victories including the end of surprise medical bills, said the consumer group TexPIRG on Tuesday.

Surprise medical bills will no longer affect consumers in Texas with a non-federal insurance plan after bipartisan work on Senator Hancock’s SB1264. The bill expands on a Texas Department of Insurance program that sends eligible surprise medical bills to an arbitration process between the insurance company and the healthcare provider. Before, consumers had to be aware of their eligibility and submit a request, but with the update, consumers will no longer even receive the surprise medical bill in the first place, significantly increasing utilization.    

The rest of the good news:

  • A bill by Representative Oliverson will prevent hidden fees at freestanding emergency rooms, ending a prominent consumer abuse.

  • Telemarketers won’t be able to “spoof” their calls anymore, thanks to Representative Leman’s HB1992. Spoofing is the practice where robocallers make their calls appear as if they originate from the same area code as the individual they are calling.

  • The Lower Colorado River Authority will be more transparent after TexPIRG and others called for changes as part of legislation to reauthorize the agency.

  • SB9, a bill that would reduce voter participation by making it harder to register and vote, was not passed. The bill was authored by Republic Senator Hughes.

  • HB3040, authored by Representative Hunter, will study how we select our judges, including whether or not elections or appointments will lead to more qualified, representative judicial nominees.

  • None of the many bills designed to block construction of a high-speed bullet train from Houston to Dallas passed, continuing the possibility of reduced congestion on I45 and lower transportation-related air emissions.

  • Bills to increase transparency in government spending, such as Representative Canales’ HB81, which requires disclosure of public spending on entertainment events, sometimes referred to as the Enrique Iglesias bill, after public spending on a concert by that artist received significant public criticism for the expenditure amount being hidden from the taxpayer.

“We were pleased with how the legislative session turned out, especially with the amount of transparency and healthcare-related bills that passed,” said Bay Scoggin, TexPIRG’s Director. “Consumers benefit from more transparency, in government, businesses, and markets, and we saw a concerted effort to pursue that goal.”

“Ending surprise medical bills for a large portion of Texas consumers and enacting one of the strongest arbitration programs in the country will serve healthcare consumers well in the coming years,” continued Scoggin.
